PURPOSES OF DATA PROCESSING AND CATEGORIES OF DATA PROCESSED

For what purpose and for how long will we process your personal data?

Your personal data will be processed by OPKO for the following purposes:

  • To carry out the sale or promotion of our products and to maintain and manage the contractual relationship. The data will be retained for this purpose for as long as the contract remains in force and, once it has ended, for the statutory limitation period applicable to any liabilities arising from the contract.
  • To manage the sending of OPKO commercial communications related to the purposes indicated above, by electronic and/or conventional means, which we will retain for as long as you do not indicate otherwise by ticking the relevant boxes or, where applicable, object to or withdraw your consent.

What categories of data do we process?

OPKO processes the following categories of data:

  • Identification data: first name, surname(s), national ID number, postal address, email address.
  • Personal characteristics data (job title and company).
  • Commercial information data.
  • Economic, financial or insurance data.

The requested personal data is mandatory; refusal to provide it will make it impossible to carry out the provision of the contracted services.

The legal basis for OPKO’s processing of your data is the business relationship we maintain and, where applicable, the proper performance of the requested contract, without which fulfilment of the contract would not be possible.

In addition, the legal basis for sending commercial communications about products and services similar to those you contracted is the consent you gave us, which we now ask you to confirm, on the understanding that you may withdraw it at any time, in cases where processing cannot be based on legitimate interest. However, withdrawing your consent will not affect the lawfulness of any processing carried out before the withdrawal.

The consents obtained for the purposes mentioned above are independent of one another, so you may withdraw one or more of them without affecting the others.

Who will your data be shared with?

Your data may be shared with:

  • Public authorities, in cases provided for by law.
  • State security forces and the National Intelligence Centre (CNI), as established by law.
  • Banks and financial institutions, for payment of the services provided.
  • Other companies within the corporate group, of Spanish nationality, for internal administrative purposes and the management of the contracted products and services.

What are your rights?

You can send a written request to OPKO HEALTH SPAIN, S.L.U., Plaça d’Europa, 13-15, L’Hospitalet del Llobregat (08908 Barcelona), Spain, or to the email address ProteccionDeDatos.Spain@opko.com, with the reference “Data Protection”, enclosing a copy of your ID document, to exercise the following rights at any time and free of charge:

  • Withdraw any consent given.

  • Obtain confirmation as to whether or not OPKO is processing personal data concerning you.

  • Access your personal data.

  • Rectify inaccurate or incomplete data.

  • Request the erasure of your data when, among other reasons, it is no longer necessary for the purposes for which it was collected.

  • Obtain from OPKO the restriction of processing of your data when any of the conditions set out in data protection regulations are met.

  • Object to the processing of your data. OPKO will stop processing the data, except for compelling legitimate grounds or the exercise or defence of possible claims.

  • Request the portability of your data.

  • Lodge a complaint regarding the protection of your personal data with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD) (by post, through the public administration registries, or using the agency’s electronic office at http://sedeagpd.gob.es/sede-electronica-web/).
